Terms and Conditions for the "Give Feedback Win an iPod" Promotional Contest

These Terms and Conditions are being entered into between Quikr India Private Limited (including its affiliates, holding & subsidiary companies) (individually and collectively be known as Quikr) and all registered users (You) at www.quikr.com (Site) who enter the "Give Feedback Win an iPod" Promotional Contest (Contest).

Contest Duration and declaration of result:

Contest will start on 11th August, 2011 (00:00:01 hours). One lucky winner would be chosen every month.

Eligibility Criterion for participation in the Contest:

1. You should be a registered user of www.quikr.com and should fill-in / provide necessary details about yourself on the web-page designated for this Contest.
2. You should not be in violation of the User Agreement, Trust & Safety rules and any other applicable policies on the Site.

Winning Criterion & Reward:

1. One lucky winner every month participating in the Contest shall be eligible to win an Ipod Shuffle 2GB (the model, brand, quality and value of the aforesaid prizes would be of the choice of the Contest administrator).
2. The winner would be decided based on a lucky draw from all the eligible entries.
3. The lucky winner will be selected by an independent third party. The judges will choose winners and no correspondence will be entertained regarding the final decision, which shall be at the sole discretion of the third party agency.
4. The winner will be intimated by post/courier or email or the telephone number at the correspondence address / email address / telephone number provided at the time of registration on the Site. If Quikr is not able to contact the winner by midnight seven days after Quikr's first attempted notification, Quikr reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse.
5. Quikr or the administrator of this Contest would undertake reasonable efforts to deliver the prize (which will be free of any shipment charges) within 45 days from the date of declaration of results, but this is subject to variation by the suppliers of the prize. Quikr or the administrator shall not be liable or held accountable for any delay in delivery of the prize.
6. Quikr or the administrator shall not obtain any shipment / delivery related insurance for delivery of the prizes. The winner shall assume the risk of damage, destruction or loss of prizes during transit.
7. All product and service related issues/warranties are the responsibility of the manufacturer of the prize item. Quikr is neither responsible nor guarantees the quality of the prize items, nor it is liable for any defect or deficiency or shortcoming or any risk associated with the prize items.

Miscellaneous:

1. Quikr reserves the right at anytime, without previous notice, to add, alter, modify, change or vary all or any of these Terms and Conditions or to replace, wholly or in part, this Contest by another Contest, whether similar to this Contest or not, or to withdraw it altogether. You hereby agree to be bound by such revised Terms and Conditions.
2. All decisions by Quikr regarding the selection of winners shall be final and binding. No correspondence or appeals will be entertained in this regard.
3. The employees and the immediate family members of the employees of Quikr and its associate companies shall not be eligible to participate in the Contest.
4. Quikr does not warrant that the Site will run concurrently and error free during or after the Contest Period and does not commit any uptime of the Site.
5. Quikr does not accept, and is not responsible for, any lost or delayed entries. Quikr reminds participants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Contest.
6. You understand and agree that participation in the Contest for the purpose of being rewarded to be promoted is good and sufficient consideration for You to agree and bound by these Terms and Conditions.
7. Any and all taxes, including without limitation income tax and/or service tax, if any applicable on this Contest and the rewards thereto shall be borne by You and You shall deposit the applicable amount of taxes to the appropriate governmental authorities before You could avail any rewards, unless otherwise mandated under the applicable laws.
8. Any disputes arising out of this Contest shall be subject to the exclusive jurisdiction of competent courts in Mumbai irrespective of whether courts in other areas have concurrent or similar jurisdiction.
